Terms of Use & EULA

These Terms of Use and End User License Agreement ("Terms" or "EULA") constitute a legal agreement between you ("you" or "User") and AS Peoria LLC d/b/a Avid Solutions International ("Licensor", "we", "us", "our") for use of the Habit AI Coach iOS application (the "App"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms are entered into between you and the Licensor, not with Apple Inc. Apple is not responsible for the App or its content.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, as permitted by the App Store Terms of Service.

2. Premium Subscriptions

Auto-Renewable Subscription Disclosure

Premium Monthly Automatically renews each month. Price displayed at time of purchase in the App and in the App Store.
Premium Yearly Automatically renews each year. Price displayed at time of purchase in the App and in the App Store.
Free features Up to 5 habits, basic tracking, AI coaching (limited), ads displayed.
Premium features Unlimited habits, advanced streak analytics, personalized AI coaching, weekly progress reports, no advertisements.
Billing Charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
Renewal Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
Managing / cancelling Manage or cancel your subscription in iOS Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current paid period; you retain Premium access until then.
Free trial If a free trial is offered, unused portion is forfeited upon purchase of a subscription.

Subscriptions are managed and billed by Apple. We do not store your payment information. All billing disputes must be resolved through Apple's standard App Store refund process at reportaproblem.apple.com.

4. AI Coaching Feature

The AI Coach feature uses a third-party artificial intelligence API (Anthropic, Inc.) to generate personalized coaching responses. AI-generated content is provided for informational and motivational purposes only and does not constitute professional health, medical, or psychological advice. You are solely responsible for any decisions you make based on AI-generated responses. Do not share sensitive personal information in the AI Coach chat.

5. Intellectual Property

The App and all content, features, and functionality (including but not limited to the design, code, graphics, and text) are owned by AS Peoria LLC d/b/a Avid Solutions International and are protected by copyright, trademark, and other intellectual property laws. Your habit data that you create in the App remains yours.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your information, including the limited data shared with Anthropic for AI coaching and with Google AdMob for advertising on the free tier.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AS PEORIA LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR HABIT TRACKING HISTORY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Third-Party Claims and Apple's Role

This EULA is between you and AS Peoria LLC, not Apple. Apple has no obligation to furnish any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price. Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App, including product liability claims, consumer protection claims, intellectual property claims, or legal and regulatory claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically and without notice if you fail to comply with any provision. Upon termination you must destroy all copies of the App. Sections 5, 7, 8, and 9 survive termination.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Peoria County, Illinois.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of the App after changes constitutes acceptance of the updated Terms.
